TERMS OF SERVICE
Design Process
XForce Web Designs provides a full portfolio of projects for you to review before ordering our services, to ensure that you are comfortable with our design style. The design process for your website begins with a short questionnaire, which will help us get an idea of your style and preference for the design. Once we receive your payment and the completed questionnaire, we will begin working on your project. Once the initial design is sent, you’re allowed unlimited revisions on the design while the website is still in development. Once you’re satisfied with the design and overall website, we will transfer the website to your hosting account to make it live. Once a website is transferred to your hosting account, the design process is complete.
Time Frame
The average build time for a general website is 2-4 weeks, however, the actual build time may vary based on factors such as complexity, communication, additional requests, and unforeseen circumstances. Your project will be started on the first business day (Monday-Friday excluding national holidays) after your payment has been received. If your project needs to be rushed, you must contact us before ordering to see if we can accommodate your timeline. Rushed projects will be subject to an additional cost based on your timeline and requirements.
Communication
We offer communication through email, phone, and sometimes instant messaging. We prefer email and usually answer all emails within 24 hours, but please allow up to 48 hours before sending a follow up. We prefer email communication as it allows us to work more efficiently and keep track of our conversation history, however, you can call us anytime during our normal business hours. When working on a project together, it’s your responsibility to make timely responses as well. If after one month of no communication on your end, your project will be considered abandoned and will be archived. If you would like to resume your project, there will be a fee of $160 that must be paid prior to resuming work on your project.
Custom Design & Quotes
We offer a full range of website and graphic design services. In order to receive a custom service that is not already offered on our website, you will need to request a custom price quote. Custom price quotes are valid for a period of 30 days.
Hosting & Domains
Website hosting and domain registration are not included in the price of any services ordered from XForce Web Designs unless otherwise specified. You will be responsible for securing your own website hosting and domain name(s) for your website at your own expense. We offer website hosting setup and domain registration services however, you’re able to host your website with any company that you choose.
Payments
We accept PayPal, Visa, MasterCard, Discover, and American Express. Your project will not be started until your payment has been received and has cleared through the issuing bank. For all new clients we request 50% deposit to begin your website design or development project and the remaining 50% will be due before you take possession of the work. Repeat clients are billed upon project completion for projects under $2000.
Refunds
Refunds will be given at the sole discretion of XForce Web Designs. If at any time you are refunded for a project, in whole or in part, you immediately lose the rights and ownership to the said works created by XForce Web Designs and all rights and ownership shall be transferred back to XForce Web Designs, unless otherwise specified.
Payment Reversals & Chargebacks
XForce Web Designs will not negotiate chargebacks with any person or company. XForce Web Designs payment and refund policies are clearly outlined within this terms of service agreement and all clients are required to read and agree to these terms prior to paying for an order or placing a deposit. If you reverse a payment previously paid to XForce Web Designs, you immediately lose the rights and ownership to any works created by XForce Web Designs and all rights and ownership shall be transferred back to XForce Web Designs. Furthermore, you’ll be required to cease the use of the said works immediately. If the payment reversal was made in error, you’ll be subject to a service charge of up to $40. XForce Web Designs will make every attempt to recoup lost funds, including, but not limited to outside collection agencies.
Hours Of Operation
Typical hours of operation are Monday through Friday from 9AM to 5PM EST excluding national holidays, however, days and times may vary.
Compatibility
All website projects will be tested and compatible with the latest versions of Mozilla FireFox, Google Chrome, Internet Explorer, and Safari at the time of your project completion. XForce Web Designs does not guarantee compatibility on any browser not previously listed, older versions of those previously listed, or that your website will be continuously compatible. You can hire XForce Web Designs at a rate of $100/hour to fix browser related issues after your project is completed, should any issues arise.
Search Engine Optimization (SEO)
XForce Web Designs does not offer guaranteed results on any Search Engine Optimization (SEO) services nor does XForce Web Designs guarantee that your website will not be penalized by search engines. The algorithm that search engines use to determine search results is always changing.
Copyright & Ownership
XForce Web Designs transfers all rights and ownership of custom designs, programming, graphics, and other visual elements that have been created or written by XForce Web Designs, specifically for the client’s project, to the client upon completion of the project. Any elements, software, graphics, stock photography, or programming owned by third parties shall remain under copyright of their respective owners. XForce Web Designs reserves the right to display and/or link to any projects that XForce Web Designs is commissioned to build or create on blog posts, social media websites, print media, and various websites throughout the internet.
Website Design Credit
All websites that XForce Web Designs builds will have a link displayed in the footer (bottom) of each page that links back to the XForce Web Designs website. By ordering any website design service from XForce Web Designs, you understand and agree that this link may not be altered or removed without consent from XForce Web Designs. Removing or altering the link without consent from XForce Web Designs is a violation of these terms.
Agreement
By placing a deposit or paying for any of the services offered from XForce Web Designs, you acknowledge that you fully understand and agree to the terms listed above.
